We have tried to make it as clear as possible, but we welcome your feedback to privacy@foresightpartners.us if you have suggestions or questions. In addition, we have made these terms available under a Creative Commons Attribution-ShareAlike license, so you can use and adapt them as you see fit.
We may change these Terms of Service and/or the included Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you an email notification). The changes will become effective upon posting. We encourage you to review the Privacy Policy whenever you access the Sites to stay informed about our information practices and the ways you can help protect your privacy.
1. Definitions
We're going to use some shorthand to make this easier to read. When we say "terms," we mean these terms of service. When we say "site," we mean foresightpartners.us, the services offered through that site, and any other website or online service that links to the terms.
When we say "we," "us," "our," or "Foresight2020," we mean Foresight Partners USA Corporation. When we say "Foresight2020 Volunteers" we mean volunteers who are working with us to provide the services as described on our site. When we say "Foresight2020 content," we mean the copyrightable text, sound, graphics, and other material owned or licensed by Foresight Partners USA Corporation.
2. Accepting these terms
Please read these terms before using the site. Your use of the site and services is subject to these terms. If you do not agree to these terms, you do not have to use the site. If you do use the site, that will be interpreted as consent to these terms. If we make material changes to these terms, we'll let you know either through the site or via email (at the email address you provide). If you do not agree to those changes, you may send a request to cancel your account to privacy@foresightpartners.us. If we do not hear from you within ten days, the revised terms will apply to you.
3. Privacy policy
This Privacy Policy explains how information about you is collected, used, and disclosed by Foresight2020. This Privacy Policy applies to information we collect when you use the site. We will store your personal information for only as long as is necessary to provide you with the services requested, to improve our site, to enforce our policies, or as legally required. We may share it with some Foresight2020 Volunteers, but will not share it with any third parties, except as necessary to provide the services offered, to monitor usage, and to improve the service. We will never share or sell your personal information with advertisers or send you promotions for unrelated services.
The following clauses go into more detail.
Information We Collect
Information You Provide to Us
We collect information you provide directly to us. For example, we collect information when you fill out a form, send us an email, or otherwise communicate with us. The types of information we collect may include your name, contact information (such as email or phone number), and other information you choose to provide.
Information We Collect Automatically When You Use the Site
When you access or use our site, we automatically collect information about you, including:
- Log Information: We log information about your use of the site, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Site.
- Device Information: We may collect information about the computer or mobile device you use to access our site including the operating system and version.
- Information Collected by Cookies: We use a basic user cookie to collect information. Additionally, when we host PDFs stored on Google Drive, Google may place a NID cookie that helps them identify you. We use Google Analytics, which also uses cookies. Cookies are small data files stored on your hard drive or in device memory that helps us to improve our Site and your experience, see which areas and features of our Site are popular and count visits. Unlike other website that may have cookies that never expire, our user cookie expires after one year. For more information about cookies, and how to disable them, please see "Your Choices" below.
Use of Information
We may use information about you for various purposes, including to:
- Provide, maintain, and improve our site and send you confirmations;
- Provide and deliver the information you request;
- Contact you if other information is necessary to comply with applicable reporting requirements; and
- Monitor and analyze trends, usage, and activities in connection with our site;
We may communicate with you via email, to the email address you provide to us. Some communications, such as emails informing you about general updates, may be unsubscribed to via the unsubscribe link in the email. If you would like to cease all communications from us, please send an email to privacy@foresightpartners.us.
Foresight2020 is based in the United States and the information we collect is governed by U.S. law. By accessing or using the Sites or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries.
Sharing of Information
We may be required to disclose your personal information in order to:
- comply with the law or legal process;
- protect or defend our rights or property, or the rights or property of others;
- enforce these terms; or
- respond to claims that the content of any material on our system violates the rights of others.
If we must disclose your personal information in order to comply with the law or legal process, we will inform you (at the email address you provide) as soon as practicable, provided that it is lawful for us to do so.
Additionally, we may share information about you as follows:
- With your consent or at your direction, including if we notify you through our sites that the information you provide will be shared in a particular manner and you provide such information.
We will also aggregate user information and perform statistical analyses of the collective behavior of our members and visitors, to measure overall demographics, and to analyze how to improve our service. We may share this information with third parties (such as Google Analytics), but such aggregate information does not contain personal information other than IP addresses. In addition, we may compile and disclose aggregate information about our users for promotional or other purposes. For example, we might want to disclose that a certain percentage of our users are located within a particular geographic area or visit the site most frequently in the mornings.

Promotional Communications
You may opt out of receiving updates and newsletters by following the instructions in those emails. If you opt out, we may still send you other types of emails, such as those about your use of the site.
Do Not Track
Note that your browser settings may allow you to automatically transmit a "Do Not Track" signal to websites and online services you visit. There is no consensus among industry participants as to what "Do Not Track" means in this context. Like many websites and online services, Foresight2020 currently does not alter its practices when it receives a "Do Not Track" signal from a visitor's browser. Legal Bases for Collecting and Using Information
This website is exclusively aimed at people in the United States. It is not targeted at non-US residents in any way. If you choose to visit from a country that is not the United States, you do so at your own risk and against the policies of this site.
While we do not invite participation from those in the EU, we nevertheless aim for (but do not guarantee) consistency with the spirit of GDPR. A note here for those in the European Union about our legal grounds for processing information about you under EU data protection laws, which is that our use of your information is based on the grounds that: (1) the use is necessary in order to fulfill our commitments to you under our Terms of Service or other agreements with you or is necessary to administer your account--for example, in order to enable access to our website on your device; or (2) the use is necessary for compliance with a legal obligation; or (3) the use is necessary in order to protect your vital interests or those of another person; or (4) we have a legitimate interest in using your information--for example, to provide and update our Services, to improve our Services so that we can offer you an even better user experience, to safeguard our Services, to communicate with you, to measure, gauge, and improve the effectiveness of our advertising, and better understand user retention and attrition, to monitor and prevent any problems with our Services, and to personalize your experience; or (5) you have given us your consent.
Your Rights
If you are located in certain countries, including those that fall under the scope of the European General Data Protection Regulation (the "GDPR"), data protection laws give you rights with respect to your personal data, subject to any exemptions provided by the law, including the rights to:

- Object to our use and processing of your personal data;
- Request that we limit our use and processing of your personal data; and
- Request portability of your personal data.

Anti-Discrimination
Except in relation to the log and device data, providing your personal data (such as your email) may be a requirement necessary to be contacted by Foresight2020. Refusal to provide a means of contact will make it impossible for us to provide the requested services, products, or information as above specified.
Providing your personal data for other purposes is optional; refusal to provide your personal data for these purposes will not have any impact on the availability of performed services by Foresight2020.

4. Permitted users
Foresight2020 is designed for use by adults in the United States. You must be thirteen years of age or older to use it. If we learn that we have collected personal information from a child under the age of thirteen, we will delete that information as quickly as possible. If you believe that we might have any information from a child under the age of thirteen, please contact us at privacy@foresightpartners.us. When you use the site, you represent and warrant that you have the legal capacity to form a binding contract with us, and are doing so by your agreement to these terms.
5. Copyright and intellectual property
All Foresight2020 content, the selection, compilation, arrangement and presentation of all materials, and the overall design of the site are copyrighted by us, and are protected by US and international laws. Use of our content without our express prior written permission is strictly prohibited.
Foresightpartners.us, Foresight2020, and the Foresight2020 logos are trademarks of Foresight2020, in the United States and other countries. Our trademarks may not be used in connection with any product or service without our express written permission.
Do not submit any trade secret or confidential information through our site, or through email, outside of an existing business relationship.
6. Disclaimer of warranties
We will strive to prevent interruptions to the service and be good stewards of your data. However, the site and our services are provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not make any warranty that the site or our services will meet your requirements, or that the services will be uninterrupted, timely, secure, or error free, or that defects, if any, will be corrected. You understand that you obtain content or services through the site at your own discretion and risk.
7. Limitations of liability
Under no circumstances — including, without limitation, negligence — shall we be liable for any direct, indirect, incidental, special or consequential damages, resulting from (1) the use or the inability to use the site; (2) the cost of procurement of substitute goods and services; (3) unauthorized access to or alteration of your transmissions or data; (4) loss of profits, use, data or other intangibles, even if we have been advised of the possibility of such damages. The foregoing shall not apply to the extent prohibited by applicable law.
8. Indemnification
You agree to indemnify, defend, and hold harmless us, our officers, directors, employees, members, partners, agents, and suppliers, and their respective affiliates, officers, directors, employees, members, shareholders, partners, and agents, from any and all claims and expenses, including attorneys' fees, arising out of your use of the site, including but not limited to your violation of this agreement. We may, at our sole discretion, assume the exclusive defense and control of any matter subject to indemnification by you. The assumption of such defense or control by us, however, shall not excuse any of your indemnity obligations.
9. Right to terminate
We may at any time decide to alter, amend, modify, or terminate the site, any functionality or portion of it, all in our sole discretion, and you understand that there is no guarantee that the site or any portion or functionality of it will continue to operate or be available for any particular period of time.
10. General
These terms shall be governed by and construed in accordance with the laws of the state of New York, without giving effect to its conflict of law provisions. You agree that you will bring any claim or cause of action arising out of your use of the site in the courts located within New York, New York, and you also agree to submit to the personal and exclusive jurisdiction of those courts. You agree that any claim or cause of action arising out of your use of the site or these terms must be filed within one year after such claim or cause of action arose or it shall be forever barred, notwithstanding any statute of limitations or other law to the contrary. If any provision contained in these terms is determined unenforceable, then such provision will be severed and replaced with a new provision that most closely reflects the intent of the original provision, and the remaining provisions of these terms will remain in full force and effect. No waiver of any provision of these terms shall be effective except pursuant to a written instrument signed by us expressly waiving compliance, and any such waiver shall be effective only in the specific instance and for the specific purpose stated in such writing. You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of these terms and/or your use of the site. You may not assign any right, interest, or benefit provided under these terms or through the site without our express prior written consent. These terms set forth the entire agreement between you and us, and supersede any and all prior communications, agreements, and proposals, whether electronic, oral, or written, between you and us with respect to the site and our services. A printed version of these terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these terms and/or your use of the site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
